1. Acceptance of Terms
By downloading, installing, accessing, or using the 4mi application (the "Service"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and MCA Co., Ltd. ("Company," "we," "our," or "us").
If you do not agree to all of these Terms, you must not use the Service. Your continued use of the Service following any changes to these Terms constitutes your acceptance of those changes.
These Terms should be read in conjunction with our Privacy Policy, which describes how we collect, use, and protect your personal data.
2. Description of Service
4mi is a real-time voice AI companion application available on iOS and Android devices. The Service provides:
- Voice conversations — real-time spoken interactions with an AI companion powered by large language models.
- Personalized memory — a multi-layered memory system that allows the AI to remember your context, preferences, and past conversations across sessions.
- Emotional awareness — analysis of conversational patterns to provide empathetic and contextually appropriate responses.
- On-device voice processing — speech-to-text conversion performed locally on your device, with optional cloud fallback in noisy environments.
4mi is not a medical, therapeutic, or mental health service. It is an AI companion for general conversation and companionship. See Section 7 for the full mental health disclaimer.
3. Eligibility
To use 4mi, you must:
- Be at least 18 years of age. You will be required to confirm your age during account registration. Users under 18 are strictly prohibited from using the Service.
- Have the legal capacity to enter into a binding agreement in your jurisdiction.
- Not have been previously suspended or removed from the Service by us.
By using the Service, you represent and warrant that you meet all eligibility requirements. If we discover that you do not meet these requirements, we reserve the right to immediately terminate your account.
4. Account Registration
To access the Service, you must create an account using one of the following authentication methods:
- Google OAuth
- Apple Sign In
- Magic Link (email-based passwordless authentication)
You are responsible for:
- Maintaining the security of your account credentials and authentication methods.
- All activities that occur under your account.
- Immediately notifying us of any unauthorized use of your account.
You may not share your account with others, create multiple accounts, or transfer your account to another person. We are not liable for any loss or damage arising from your failure to maintain the security of your account.
5. Subscription & Billing
5.1 Plans

5.2 Payment Processing
Payments are processed through:
- Stripe — for direct credit card, debit card, and other supported payment methods.
- Apple In-App Purchase (IAP) — for purchases made through the iOS App Store, subject to Apple's terms and conditions.
- Google Play Billing — for purchases made through the Google Play Store, subject to Google's terms and conditions.
All prices are displayed in US Dollars unless otherwise indicated. Applicable taxes may be added at checkout depending on your jurisdiction.
5.3 Auto-Renewal
Pro subscriptions automatically renew at the end of each billing period (monthly or annually) unless you cancel before the renewal date. You will be charged the then-current subscription price at each renewal. We will notify you of any price changes in advance.
5.4 Cancellation
You may cancel your subscription at any time through:
- The app's Settings > Subscription Management screen.
- Your Apple App Store or Google Play Store subscription settings (for IAP/Play purchases).
Upon cancellation:
- You will retain access to Pro features until the end of your current billing period.
- Your memory data will be retained for 90 days after your subscription expires, in case you choose to resubscribe.
- After 90 days, your memory data will be permanently deleted and your account will revert to the Free plan.
5.5 Refunds
Refund policies depend on your payment method:
- Stripe payments — refund requests may be submitted within 14 days of the initial subscription purchase or within 7 days of a renewal charge. Contact support@4mi.app.
- Apple IAP — refunds are handled exclusively by Apple through their refund request process.
- Google Play — refunds are handled through Google Play's refund policy.
6. User Conduct
When using 4mi, you agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable local, state, national, or international law.
- Attempt to exploit, manipulate, or abuse the AI system, including attempting to extract system prompts, bypass safety features, or generate harmful content.
- Attempt to bypass the crisis detection system or any other safety feature.
- Use the Service to harass, threaten, or harm any person.
- Impersonate any person or entity, or falsely state or misrepresent your identity or affiliation.
- Reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the application.
- Use automated scripts, bots, or other tools to interact with the Service.
- Attempt to gain unauthorized access to our systems, servers, or other users' accounts.
- Transmit any malware, viruses, or other malicious code through the Service.
- Use the Service in any manner that could damage, disable, overburden, or impair our infrastructure.
- Share, distribute, or publicly display AI-generated responses in a way that misrepresents them as human-generated professional advice (medical, legal, financial, or otherwise).
We reserve the right to suspend or terminate your account if you violate any of these conduct rules, at our sole discretion and without prior notice.
7. Mental Health Disclaimer
4mi is NOT a therapy service, counseling tool, medical device, or mental health intervention.
You expressly acknowledge and agree that:
- 4mi is an AI companion for general conversation and companionship only. It does not provide medical advice, mental health counseling, therapy, psychiatric services, or crisis intervention.
- The AI's responses are generated by machine learning models and should not be relied upon as professional advice of any kind.
- 4mi is not a substitute for professional mental health care. If you are experiencing a mental health crisis, you should contact a qualified professional or emergency services.
- The emotional awareness and memory features of 4mi are designed to improve conversational quality and do not constitute psychological assessment, diagnosis, or treatment.
7.1 Crisis Detection
4mi includes an always-on crisis detection system that cannot be disabled. This system monitors conversation text for indicators of suicidal ideation, self-harm, or other crisis situations. When such indicators are detected:
- The 988 Suicide & Crisis Lifeline (call or text 988) and relevant local crisis resources will be immediately displayed.
- The current conversation session will be ended.
This disclaimer is presented to all users during account registration and must be acknowledged before using the Service.

8. Intellectual Property
8.1 Our Intellectual Property
The Service, including its design, features, functionality, code, AI models, prompts, user interface, branding, logos, and all associated intellectual property, is and shall remain the exclusive property of MCA Co., Ltd. and its licensors. These Terms do not grant you any right, title, or interest in the Service beyond the limited right to use it in accordance with these Terms.
8.2 Your Content
You retain ownership of the content you provide to 4mi through conversations (your spoken words, as transcribed). By using the Service, you grant us a limited, non-exclusive license to process your content solely for the purpose of providing and improving the Service, including:
- Generating AI responses to your conversations.
- Creating and maintaining your personalized memory profile.
- Performing post-session memory extraction.
This license terminates when you delete your account or specific content.
8.3 AI-Generated Content
Responses generated by the 4mi AI are provided for your personal use. You acknowledge that AI-generated content may not always be accurate, complete, or appropriate, and you use such content at your own risk. You may not represent AI-generated content as professional advice.
9. Privacy
Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using the Service, you consent to the data practices described in the Privacy Policy.
Key privacy commitments include:
- Voice audio is processed on-device and never stored on our servers.
- All stored data is encrypted at rest using AES-256-GCM.
- We do not sell or share your data with advertisers.
- You can export or delete your data at any time.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:
- THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.
- WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.
- WE DO NOT WARRANT THE ACCURACY, COMPLETENESS, OR RELIABILITY OF ANY AI-GENERATED CONTENT OR RESPONSES.
- IN NO EVENT SHALL MCA CO., LTD., ITS DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:
- Your access to, use of, or inability to use the Service.
- Any conduct or content of any third party on or related to the Service.
- Any AI-generated content or responses.
- Unauthorized access, use, or alteration of your transmissions or content.
- Any reliance on the Service for medical, mental health, therapeutic, or professional advice.
- OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU HAVE PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liabilities, so some of the above limitations may not apply to you. In such jurisdictions, our liability shall be limited to the maximum extent permitted by law.
11. Indemnification
You agree to indemnify, defend, and hold harmless MCA Co., Ltd. and its directors, officers, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of the Service.
- Your violation of these Terms.
- Your violation of any rights of a third party.
- Your misrepresentation of AI-generated content as professional advice.
12. Termination
12.1 By You
You may terminate your account at any time by deleting your account through the app's Settings. Upon account deletion, all your personal data, conversation history, and memory profile will be permanently deleted from our servers within 30 days.
12.2 By Us
We may suspend or terminate your account and access to the Service at any time, with or without cause and with or without notice, including but not limited to the following reasons:
- Violation of these Terms or any applicable law.
- Conduct that we determine, in our sole discretion, is harmful to other users, us, or third parties.
- Attempts to circumvent safety features, including crisis detection.
- Extended periods of inactivity (12 months or more).
12.3 Effect of Termination
Upon termination:
- Your right to use the Service will immediately cease.
- Any outstanding subscription fees remain your obligation.
- Sections 7 (Mental Health Disclaimer), 8 (Intellectual Property), 10 (Limitation of Liability), 11 (Indemnification), 13 (Governing Law), and 14 (Contact Information) shall survive termination.
13. Changes to Terms
We reserve the right to modify these Terms at any time. When we make material changes, we will:
- Update the "Last Updated" date at the top of this page.
- Provide notice through the app via an in-app notification at least 30 days before the changes take effect.
- For changes that materially affect your rights or obligations, require your affirmative acknowledgment before the updated Terms take effect.
If you disagree with the updated Terms, you must stop using the Service and delete your account before the changes take effect. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of those changes.
14. Governing Law & Dispute Resolution
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.
14.2 Dispute Resolution
Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be resolved through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may submit the dispute to binding arbitration administered by the Korean Commercial Arbitration Board (KCAB) in Seoul, Republic of Korea.
14.3 Class Action Waiver
To the maximum extent permitted by applicable law, you agree that any dispute resolution proceedings will be conducted on an individual basis and not in a class, consolidated, or representative action. You waive any right to participate in a class action lawsuit or class-wide arbitration against MCA Co., Ltd.
15. General Provisions
- Entire Agreement — these Terms, together with the Privacy Policy, constitute the entire agreement between you and MCA Co., Ltd. regarding the Service.
- Severability — if any provision of these Terms is held to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Waiver — our failure to enforce any right or provision of these Terms shall not be considered a waiver of those rights.
- Assignment — you may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
- Force Majeure — we shall not be liable for any delay or failure in performance resulting from causes beyond our reasonable control, including natural disasters, war, terrorism, pandemics, labor disputes, government actions, or failures of third-party services.
